Hear from experts on the specific pressures facing hospitals, long term care facilities, and others in the healthcare sector, and the unique regulatory and reimbursement challenges which arise in restructuring. Darlene Davis, Felicia Gerber Perlman, Cynthia Romano, and Anzhelika Shatrov will address causes of distress in the healthcare sector and discuss important considerations you need to know when negotiating financial and operational turnarounds for healthcare clients.

Session attendees will:

  • Identify specific issues causing distress in the healthcare sector
  • Recognize challenges which affect the revenue cycle of healthcare entities
  • Learn the unique implications in sales and transfers of healthcare organization assets
  • Understand the movement towards out-of-court workouts

Participants will earn 1.2 CPE credits in Business Law.

Darlene Davis, K&L Gates

Ms. Davis is a partner in the Research Triangle Park office. She focuses her practice exclusively on health law, primarily representing academic medical centers, health systems, hospitals, home health agencies, hospices, nursing homes, and ancillary service providers, such as laboratories, pharmacies, and durable medical equipment suppliers.

In that capacity, she advises clients on a wide range of regulatory and transactional matters, including the HIPAA privacy, security and breach notification rules; Medicare and Medicaid enrollment and certification, coverage and reimbursement; North Carolina licensure rules; the 340B drug pricing program; contracting; health care regulatory diligence; and compliance with fraud and abuse laws (including Stark Law and Anti-Kickback Statute).

Prior to attending law school, Ms. Davis worked for the Centers for Medicare & Medicaid Services in its Boston Regional Office.
 

Felicia Gerber Perlman, Skadden, Arps, Slate, Meagher & Flom LLP

Felicia Gerber Perlman is a partner with Skadden, Arps, Slate, Meagher & Flom LLP in Chicago and represents clients in a variety of complex business reorganizations, debt restructurings, and insolvency matters. She has advised debtors, creditors, lenders, investors, sellers, purchasers, and other parties-in-interest in all stages of restructuring transactions, from Chapter 11 reorganizations to out-of-court negotiations, workouts, and acquisitions, and has extensive experience across a wide range of industries, including healthcare.

Perlman is a frequent speaker on bankruptcy topics and has been recognized in Turnarounds & Workouts as one of the nation’s Outstanding Young Bankruptcy Lawyers and has been repeatedly included in Chambers USA. She received the 2017 Flex Success Award from The Diversity & Flexibility Alliance for her commitment and success in creating and working in a flexible environment. She also was named by Crain’s Custom Media as one of Chicago’s Notable Women Lawyers in 2018.
